Can child porn be a crime when it involves no actual children? A Danish appellate court has so ruled in sentencing AI artist Barry Coty to 18 months’ in prison. Denmark used to be famous as a place where even real child pornography was legal, during which time sex offense rates actually went down. Outlawing purely imaginary sexual images or fiction is a growing trend in multiple countries, Canada and the US included. For example, in Virginia in 2023, a federal inmate who was found to have drawn sexualized images of children was sentenced to an additional 15 years, longer than his original 10 year sentence for possessing real images of children.
