Eliminating the “X” Gender Marker on Passports

The Trump administration has asked the U.S. Supreme Court to reinstate a policy requiring passport gender markers to match the sex listed on one’s birth certificate. The policy would undo lower-court rulings that allow transgender and nonbinary individuals to use identity-consistent markers, including an “X.” This dispute is one of several over an executive order Trump signed after returning to office. In April 2025, the Trump administration also updated it’s US Citizenship and Immigration Policy Manual to only recognize two biological sexes, male and female.
