While many states have criminalized use of public bathrooms that align with a transgender person’s gender identity, Idaho is the first to criminalize such use even in private businesses that might wish to be LGBT-inclusive. Under the new bill, the first offense would be a misdemeanor, but a second offense would be treated as a felony. To say nothing of the embarrassment they cause trans people themselves, such counter-productive laws could make easily offended cis-folks even more upset, insofar as they would force trans men who pass as men into women’s bathrooms and vice versa.
