Fighting for Reproductive Health Care in 2026

Although reproductive health care will be on the ballot in 2026, the most consequential questions may be answered in the courts. There is little political support for a nationwide abortion ban so those pushing to limit reproductive health care are circumventing the will of the people by going to the courts. Mifepristone, a commonly used abortion medication, was approved by the FDA over 25 years ago and is proven safe and effective. Regardless of the data, in 2022 the Alliance for Hippocratic Medicine, a coalition of anti-abortion physicians, sued the FDA for approving the drug. In 2024, the Supreme Court ruled that the case had no standing. Other states have sued the FDA challenging the FDA’s regulation of the drug. Now Florida and Texas have filed a lawsuit seeking to nationally restrict the abortion medication. If successful, the restriction will obstruct reproductive health care in states with abortion bans putting women at risk.
