Following an April 2025 Supreme Court ruling that inmates must be assigned to prisons based on biological sex rather than gender identity, Scotland’s ruling party has determined that it will not contest the issue further and will transfer trans women into men’s prisons. Since 2014, Scotland has housed trans women in women’s prisons, but this policy led to widespread backlash from women’s groups and author J. K. Rowling, particularly when it was reported that rapists and sex offenders were being housed together with women. Unfortunately, Scotland’s overly liberal policy of allowing male inmates to be classified as “trans women” based on mere self-declaration, rather than actual medical procedures, discredited the whole enterprise, causing the genuinely transgendered to lose the safer environment women’s prisons afforded them.
