More Setbacks for Trans Advocates

The Supreme Court ruling in Mirabelli v. Bonta, which we also report, is not the only recent legal setback for trans advocates. The 4th Circuit Court of Appeals upheld a West Virginia law that allowed the state to withhold Medicaid funding for all trans surgeries, including those of adults . In Texas, Attorney General Ken Paxton, a populist who is challenging the more establishmentarian Republican incumbent in this year’s US Senate race, has won a state court’s ruling to enjoin a New York fashion distributor from shipping chest binders to any minors within the State of Texas, classifying them as “actually dangerous Class I medical devices” that pose “immediate” and “irreparable” harm. Perhaps most consequential is the attempt to federalize a ban on trans surgeries for minors and trans participation in female athletics, which has been incorporated into the otherwise unrelated SAVE Act (on voter ID). Trump has threatened to veto all other legislation until this bill is passed, and Republican senators have even contemplated modifying the filibuster rules to ram this proposal through.
